Instagram Contest Rules

#PietsVilla4Free Instagram Sweepstake Rules

The #PietsVilla4free Instagram sweepstakes runs from July 01, 2015 (12 noon) until August 31, 2015 (11:59pm) CEST.

The prizes are:

1st place Grand Prize consisting of:

- 1 Villa (accommodating up to 8 guests) for 7 nights at Piet Boon Bonaire, Kralendijk, Bonaire

2nd place prize consisting of:

- 1 REISS X Steamline Luggage set (1 Gallivant wheeled suitcase and 1 Wayfarer wheeled suitcase)

 3 – 5th place runner-up prizes consisting of:

- 1 The Design Hotels™ Book 2015

 

 The following sweepstakes terms and conditions are made to provide clarity on many aspects. Please do not hesitate to contact us when you have any questions or remarks.

 1.    This sweepstake is organized by Design Hotels AG, Stralauer Allee 2c, 10245 Berlin hereinafter referred to as “Design Hotels™”.

 2. The Design Hotels™ #PietsVilla4free sweepstake is open to all individuals that have reached the age of 18 and that participate for private purposes only. Directors, officers, management, employees, other staff and family members of Design Hotels™ or any of its affiliated companies and other persons involved in this sweepstake are not eligible to enter this sweepstake.

3. The Sweepstakes is open from July 01, 2015 (12 noon) until August 31, 2015 (11:59pm) CEST.

4. Participants may enter the sweepstake as often as they want by:

 -Uploading a picture onto Instagram for which they have the sole property rights, proving they have artistically recreated the Design Hotels™ circle logo. This could be a photo of a painted, drawn, collaged, sculpted logo.

- Participants must follow @design_hotels on Instagram

- Participants must tag the image with #Piets4Villa4free #DesignHotels #MadebyOriginals and @design_hotels

The images will then be displayed on a number of #Piets4Villa4free galleries found on various Design Hotels™ social channels as well Design Hotels™ websites.

- Any Submission that does not include the tags #Piets4Villa4free #DesignHotels #MadebyOriginals and @design_hotels will not be considered for entry into the sweepstake.

- No purchase necessary to enter or win this contest.

5. By entering the sweepstake and submitting photographs, participants grant to Design Hotels™  a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to exploit the intellectual property as vested in the photographic work. Participants declare that they are the sole owner of the intellectual property rights of the uploaded and/or tagged photo and indemnify Design Hotels™ for any intellectual property claims regarding the uploaded and/or tagged photo.

 6. Winner Determination:  At the end of the Contest Period, Design Hotels™ will monitor and review the initial submissions for eligibility. A panel of qualified judges determined by Design Hotels™  in its sole discretion will select five (5) entrants with the highest-scoring Submissions, the potential Grand Prize winners, from among all eligible submissions based on the following criteria (“Judging Criteria”):

- Creativity/Originality (40%);

- Quality of Submission/Photographic Quality (30%); and

- Recognizability / Content (30%)

In the event of a tie, the entrant whose submission received the highest score for Fit to Sweepstakes

Grand Prize, second Prize, third – fifth prize winners may not be the same person.

At the end of the sweepstake period, the winners’s posts will be featured on Design Hotels™ social media channels and will be contacted by Design Hotels™ within 14 days via the (social media) channel that used to enter the sweepstake. .The winners will have to confirm acceptance of the prize within seven days and provide an email and postal address. The prize will then be sent by Email / post. If a delivery is not possible, e.g. because a false address was provided or if the winner does not react within 7 days after the information about the prize, Design Hotels™ reserves the right to select another winner at its sole discretion.

8. The Grand Prize is valid for stays until July 31, 2016. Stay dates are subject to hotel availability. Black-out dates apply.

- The Grand Prize cannot be taken between December 15, 2015 and January 15, 2016.

- The costs of traveling to the hotel are not included and must be paid by the winner.

- Bonaire tourist tax of USD 5.50 per person per day is not included and must be paid by the winner.

- The Grand Prize winner and guests must have a full passports valid for at least six months at time of travel.

- Any necessary visas are the responsibility of the Grand Prize winner and guest.

- The Grand Prize does not include transfers, personal expenses, service charges or any other service or item not specifically described above.

- If for any reason the Grand Prize winner is unavailable to redeem the prize and travel to Bonaire, Design Hotels™ not responsible. The prize will then be forfeited and the winner will not receive a replacement prize.

9. To join the sweepstake, submissions must be received before the end of the sweepstake period. Design Hotels™’s decisions as to the administration and operation of the sweepstake and the selection of the potential winners are final and binding in all matters related to the sweepstake and is not open for correspondence with Design Hotels™ .

10. No cash redemptions or prize substitutions allowed. The prizes, or any unused portion thereof, cannot be returned, are non-transferable or exchangeable and cannot be taken as cash. For all prizes there are no cash alternatives available nor can be transferred, sold, auctioned or exchanged.

11. Any entry not complying with these terms and conditions is invalid. The winners may be required to provide a written acknowledgement of acceptance of all terms and conditions of the sweepstake.

12. Participants accept that:

- Participants may not use the sweepstake for the expression of political or religious ideas, pornography, obscenity, vulgarity, hatred, bigotry, racism or gratuitous violence.

- Design Hotels™  has the right to refuse any entry which contains material which is offensive, injurious, obscene, vindictive, indecent, immoral, aggressive, sexually oriented, racist, derisive, slanderous, discriminatory, or in any other way not in line with good taste and decency, or which Design Hotels™ deems in its sole discretion to be otherwise unacceptable.

- Entries may not conflict with applicable law or regulations, or the rights of third parties, including without limitation featuring people who have not consented to their image being entered and featuring copy right protected works or names, logos and registered trademarks without the rights holders consent.

- Entries may not in any way harm Design Hotels™, its affiliates, its agents and/or the Design Hotels™ brand.

- Participants may not upload, or post, any material that contains software viruses or any other computer codes, files or programs designed to interrupt, destroy or limit the use of any software or devices.

- Design Hotels™  retains the right to exclude participants from participating in the sweepstake and to delete entries if these are not in line with these General Rules of Conduct or are otherwise in conflict with these terms and conditions.

13. Design Hotels™ explicitly reserves the right to refuse or remove a submission of an entrant, at its sole discretion, in the event Design Hotels™  determines an entrant does not comply with all rules and regulations as contained herein.

14. If for any reason any aspect of this sweepstake is not capable of running as planned, including by reason of infection by computer virus, telephone network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of Design Hotels™ , Design Hotels™ reserves the right, at its sole discretion to cancel, terminate, modify or suspend the sweepstake, or invalidate any affected entries.

15. Design Hotels™  reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or operation of Design Hotels™  or to be acting in violation of these terms and conditions or in an unsportsmanlike or disruptive manner.

16. Design Hotels™  collects personal information obtained from the winners to send them their prize and may, for this purpose only, disclose such information to third parties.

17. Participants should direct any request to access, update or correct their personal information to Design Hotels™  . All personal details will be held and dealt with in accordance with the Design Hotels™  Privacy Policy, which can be accessed at https://www.designhotels.com/privacy-policy and any copyright subsisting in the entries become and remain the property of Design Hotels™ .

18. Design Hotels™  (including its officers, employees and agents) exclude all liability (including negligence) for any personal injury or any loss or damage otherwise arising out of or in connection, directly or indirectly, with this sweepstake, the prize(s) or technical difficulties or equipment malfunction (whether or not under Design Hotels™ ’s control).

19. By participating in the sweepstake, all Participants agree to release and hold harmless Design Hotels™, and its affiliates, suppliers, distributors, parent companies, and each of Design Hotels™’s officers, directors, employees and agents, from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the sweepstake or receipt or use or misuse of any prize.

20.   The competition is subject to German law. Any recourse to courts is excluded.    

21. The Organizer is responsible for provision of a prize. The Organizer accepts no responsibility for the quality of service received, the availability of specific services, or the failure of any third party to fulfil its contractual obligations when the entrant redeems their prize or gift voucher. Any complaint about the service or quality issues affecting the redemption of your prize or gift voucher should be resolved directly with the service provider. The Promoter is in no way endorsing the services of the third parties in this promotion.
